HI, THANKS FOR YOUR TIME.IM BEING SUED BY A COMPANY THAT BUYS CC ACCOUNT(LNVN FUNDING)ITS A SMALL AMOUNT(918.00) SO IM TRYING TO REPRESENT MYSELF
FIRST OF ALL I HAVE NO IDEA WHAT THIS ACCOUNT IS I NEVER HAD A ACCOUNT WITH THIS CC (CAPITOLONE) SO I DON'T KNOW IF THIS IS IDENITY THEFT, MISTAKEN IDENITY ARE WHAT.AND I ANSWERED THE SUMMONS THAT WAY. I SAID I HAVE NO IDEA WHAT THIS IS.
I GUESS THAT A AFFIRMATIVE DEFENCE .SO THEN I RECEVIED FROM THEIR ATTORNEY
INTERROGATORIES,REQUEST FOR PRODUCTION OF DOCUMENTS AND REQUEST OF ADMISSION.
MY QUESTION IS HOW DO I FIND OUT WHAT INFORMATION THEY HAVE?DO I NEED TO FILE A MOTION FOR DISCOVERY,PRODUCTION OF DOCUMENTS?AND WHAT QUESTION SHOULD I ASK?
WHAT IS THE PROCESS FOR FILING REQUEST FOR DISCOVERY?

You CAN file your own request for discovery and production of documents, yes. I would, in fact, do so.

Crap 1 BUYS old debts from other companies, so you may not have ever had a Crap 1 card. LVNV Funding (aka Sherman Acquisitions) is a junk debt BUYER, so in this case it's impossible to know what the real story is.

Ask them to produce proof the same way they are asking you !

Lack of knowlege of a debt is NOT an affirmative defense.
