Drive Financial didn't follow through


Montana - I purchased a truck back in 2006 and it was financed through Drive Financial. It was purchased and registered in Colorado. In September of 2007 I moved back to Montana. In order to register the truck in MT I needed to have the title changed as well. I contacted Drive to find out how to go about it (since they hold the title) and they advised the form that needed to be sent to them. After receipt of the form they would send the title to the State of Montana for the transfer. I found, filled out and faxed the form to them as requested. Many phone calls and weeks later Drive never sent the title to MT. I even called the county office to make sure. They continued to take my money but wouldn't take care of a simple title transfer. It was now illegal to drive my vehicle in MT due to residency. I was pulled over several times by MHP because of the out of state plates. I finally told Drive they wouldn't get another payment until they followed through on the title. 4 months of arguements and threats on the part of Drive followed but no title transfer. I finally told them to come get the truck because I could no longer drive it without getting further citations. 2 months after that they sent for the truck. They sold it at auction for $5k and have me in collections for $29k.

Long and short of it...do I have any recourse? It became a legal problem to drive the vehicle but they never took the steps to remedy the situation.

You didn't have to default on your contract or drive it without proper registration. Now you have to pay for a truck you don't even have.
