Emergency Assistance Needed!!


What is the name of your state? Ohio

I have been sued by a debt collection agency representing Capital One.

I did some research on the internet and filed for debt verification within the 28 day time frame. I did not, however, file the sworn denial, which I am now thinking had to be filed within the time frame.

I was waiting on debt verification before I filed the sworn denial. Well debt verification showed up on saturday and my trial is tomorrow.

Can I still file the sworn denial or am I just walking in to receive my default judgement tomorrow?

Any assistance would be greatly appreciated.

You lost.

You needed to file an answer to the suit and you didn't.

That was what I was afraid of. I will make sure and post the post mortum tomorrow so others can benefit from my stupidity.

Any hope of trying to settle before the case goes to court?

Asking for VALIDATION in response to a lawsuit is a waste of time and not a proper response.

It's ALREADY 'in court' - and when you failed to file your answer the judgment creditor asked for a summary judgment - which would be granted.
