ex husband's bankruptcy


What is the name of your state?al 2 years after our divorce a credit card my ex had in our names was paid in full. He however kept the card and now 9 years after the divorce has declared bankruptcy. This creditor is trying to hold me responsible for the debt he has incurred since the balance was paid off. Am I responsible?K

Ummm -- probably.

Credit cards are revolving debts. That means the balance goes up and down all the time. Just because the balance was paid to zero does not mean the account was closed.

You would have been protected if the account had been paid off and closed. Your ex could have gotten a new card and it would be only his responsibility.

But, since the card was only paid to zero and not closed and then the balance grew again -- it is still the same card and you are still liable just as if you had made the charges yourself.

I know this is unfair to you. But, in my view, you are still liable on the card.

If someone has a different opinion, I'm sure they will speak up.

Unfortunately, DebtGuy is right. As long as that account remained JOINT and open, YOU are just as liable for the debt as your EX.

Question - do you know when he last made payment on this account ??? It probably IS on your credit reports since its a joint debt, have you looked ???
