ex wifes debts


What is the name of your state? Tennessee

This is what has happened, me and my ex have been divorced for almost 6 years, a few days ago a collection agency called my home asking for her.
i told them she was my ex wife and that we've been divorce for 6 years or so.
apparently she had opened a credit card account during our marrage that i was unaware of. the collection agency told me that i was liable for the payoff on this account since we were married at the time it was opened. ok this credit card was only in her name, i can't see how i would be liable for a credit card account that she opened, but the guy told me that if i didn't pay it and if she didn't it would go on both our credit reports. my question is, Is this guy bluffing? can it really be put on my credit report?

Not in Tennessee. If he calls again ask him where the dunning letter he is required to send within 5 days of first contact is. Then tell him that he has two FDCPA violations, next time he contacts you -- you will discuss your options with an attorney. That, of course, will do very little and you will be contacted again -- but you do have the chance to make some cash.

Sounds like he is trying to scare you into paying. They want the money some way or another. You're not liable to pay her debt.

Follow the above advice - I think the violations (if you win) are $1000 fine that you can sue the collections agency for

Thanks for the info, i feel that it will prove to be useful if this company continues to bother me, also i checked with my local banks legal dept. and they said pretty much the same things. Anyways thanks again.
