Finding where people work. Second time.


Yes English and spelling wasn't my strong suit. Was trying to not name names etc. Trying to be short and to the point. Will try again. This is also Nebraska.

O.K. I sold some hay to some people about a year ago. I got partial payment, but not full. Havent been able to get anything from them since. So I took them to small claims court and won. Got a garnishment order or what ever your would call it against Mr and Mrs Jon Doe.

In different conversations with Jon Doe he stated that his wife (presuming they are married) worked at a hospital in the big city they live close to. They have a public one and the VA.

So when I decided to garnish Mr and Mrs Jon Doe I put down his place of employment which I knew, and the hospital that I thought she worked at. Got a phone call from "human resources" of hospital A and she stated that they had 14 people there by her first name but no one with last name. She asked for SS#, which I dont have. She couldnt not look by address. I dont understand how you can employ people and not be able to look up someones address.

Since she was very helpfull I decided to call the VA and see if she worked there. Their "human resources" also stated that no one by that name worked there.

I know that he said she worked at the hospital in town and wished they could move back to "town X" so they wouldn't have to drive so far, but worried about the crime.

So I guess what Im asking is in the state of Nebraska, #1 do the privacy laws prevent me from asking if Mrs. Doe is employed there, #2 if not and they are being honest is there any places where I can search her name for place of employment.

Im very confident that hospital A is being very straight with me. I'm guessing the VA is the same. If so that means Mr Jon Doe lied to my face which is very possiable. I did check to other area towns hospitals as well.

Found a place called New Hire. Its where employers list their employees in a data base for finding dead beat child support parents. She said it was against privacy laws to realse information to me.

These people have been gone after by collection agencys and called them. Of course it was against their policy to release information to me. Of course they said they would take me on as a cliant.

Kinda makes me mad I got this judgement in my favor but dont have any leagle pull to find anything out about them with out basicly doing P.I. work. I live 100 miles from there and cant spend a lot of time doing this stuff. When I go there I do a little working around.

The collection agencies get this stuff found and I guess basicly was looking for insight here on how to accomplish this. Have figured out one of their banks, but also found that they filed bankrupcy as well.

Any help would be greatly appriecated. Sorry about being so long winded, but the previous post was confussing I guess.

Much better.

Your problem is they filed bankruptcy. That's not my area of expertise so you'll have to wait until one of the other regulars come by to get your answer. I'm answering you to move your post to the top of the board (until there's another poster in this category.)

Your problem may be that the person works there but is not employed by the hospital. Many nurses and professional staff actually work for staffing agencies which contract them out to one or more hospitals on an as-needed basis. You would have to identify and contact the staffing agencies to determine who actually employs them.

In other cases, ancalliary offices and even emergency rooms are rented out to physician practices. Those practives may employ the individual that you are looking for.

This is why collections agencies are in business. They do the legwork of tracking down the deadbeat for you.

You may also find that social networking sites and google are good places to track down info that people and their friends spill about themselves.

But the bankruptcy could be a killer. Once you are notified of the bankruptcy, your collection actions should cease, assuming that your judgement is one of the debts covered by this bankruptcy and that the BK was filed after your judgment.

Since they filed bk, you're pretty much out of luck.
Until the bk is sorted out, they are protected by the automatic stay against any collection activity. If the bk is discharged, the stay morphs into a permanent injunction.
Leave 'em alone or you could be the one writing a check.

Register for a pacer account and you'll find all the info on them you want.

Thank you country living.

Looked into pacer, seen they charge. My county court clerk has been helping me a lot. That is how I found out they filled bankruptcy. Didn't think to ask then when they filled. They have a data base of cases filled in the state's different counties. I imagine this is where pacer gets their information. Hopefully I got my judgement before they filled. The data base said collections on Jon Doe ended in April. So I guess will see what happens.

Never thought about them using a placement agency or something like that.

I got back my certified letter from his & her employer and sent them to proper county court. I imagine if something has been filled before my judgemet was placed I will find out shortly.

Hopefully I got my judgement before they filled.

That won't help. Judgments are discharged in bk.
Pacer gets there bk info directly from petitions that are filed.

I'm not a bankruptcy person; but, my understanding is you will be in trouble if they included their debt to you in a bankruptcy filing and you still try to collect.

You have to find out if they declared bankruptcy and if you are included in the list of debts.

I'm sure the BK experts will correct me if I'm wrong.

Amo, I believe the bottom line is even though you have a judgment, if they filed bankruptcy and included this debt, you cannot collect.

Ya I can see by oweing the other creditors money, because I was garnishing, but if I got my judgement against them before they filled, I should be listed as a creditor? I realize that I proably wont get paid in full then, but at least they cant just "simply forget" me in listing there creditors.

You are a creditor. The fact you got your judgment before they filed is irrelevant.

Not likely. They're filing bankruptcy to get out from under their debts. Yes, it stinks - it leaves people like you holding the bag. It also leaves people like me subsidizing their lifestyle in the way of higher prices to compensate for their failure to hold up to the agreement to repay money loaned to them in good faith. People not taking care of (that means PAYING) their financial obligations are a pet peeve of mine.

You need to find out if you're listed in their filing.

Well called county clerk and she said they filled in 2005. He was garnished sometime this year because it ended in April. So I decided to continue with the process.

Since you are going to continue, let me make a couple of observations:
1. You need to be willing to spend money to enforce your judgment. That could mean paying for database access, hiring an investigator or collection agency or selling the judgment to a professional enforcer.

2. Trying to do this on the cheap is the surest way to make a mistake.

I'm not trying to be "cheap" just "fiscally efficient"

I'm sure of where he works. County clerk said which bank he was garnished at. He also stated the same bank as well as another.

Was going to garnish both salaries, but couldn't find where she worked at. Figured that if they were smart they'd stock piled some cash somewhere.
As long as he doesn't change employment, what do I need to enforce?

Called a collections agency before I filled in small claims court. Said it was X% and if it went to court, they would take 50% of what was owed. After visiting with him twice I knew where he worked, and one of his banks. Figured I had a good chunck of the work done I guess.
