Today I received in the mail a photocopy of a magistrate's summons to appear for a small claims hearing next month. One of my creditors who I owe almost $4800 has filed for the amount owed. I have been paying them over a year through a debt management plan and missed a recent payment due to the Memorial Day holiday disbursement cutoff. I talked to a gentleman there today and told him I was sending a payment to catch up May and then they would have June by the weekend. He didn't mention anything about the small claims papers and told me he would mark my account.
Right now I only owe for the current month and I can't believe they would file a small claims against me since I'm not that far behind. They have been constantly calling me but since I work two jobs, I get home late at night at times and would leave them voice messages. They apparently didn't like that. They have also called my relatives looking for me and I asked them to stop. Since I'm almost current, does anyone feel I can work things out with them and can they withdraw the small claims hearing? My stomach is in knots and I don't know what to do. |
No one here can predict what they will do. The only thing you can do is call them and see if they will work things out. We can't call them for you.
I would, however, recommend that you send them a letter CRRRM asking them to stop harrassing your relatives. I have no idea how they would have their numbers, but you can make them stop.
