friends owe us $10,000!


What is the name of your state? Florida

Hello forum,
My mother-in-law and her husband are missionaries. They allowed supposed "friends" to borrow a credit card for use in moving to Florida approximately 7 years ago. The "friends" had a new job lined up, but no money to move and promised to pay back any money used in the move. My mother-in-law has repeatedly contacted the "friends" in regards to having the money paid back, and has received nothing but a long line of excuses. At one point, the "friends" agreed to pay her $50.00 a month, and more when it became available. My mother-in-law received about three payments, and then the payments stopped. About one year ago, mother-in-law called the "friends" and was told that they had filed for bankruptcy and that she would need to talk with their attorney. She never received a call back from the attorney, and now is wondering if the money is lost forever. My mother-in-law has retained all of the email correspondance with the "friends" and is now in real need for the money to be paid back. What might be her next step?

If they filed for bankruptcy your MIL is flat out of luck. Assuming these 'friends' included the debt to your MIL in their bankruptcy, the debt would have been discharged. Sounds like your MIL didn't get any notice of the BK as she would have had these 'friends' included her as a creditor.

Even if they didn't list her as a creditor, it's still a lost cause. If their case was a no-asset Ch 7 then ALL debts, listed or not, are considered to be discharged.

Your MIL needs to get in touch with the BK court and get a copy of the BK petition - its public record.

Maybe your MIL will get a nice tax write-off for a loss???

**A: confirm the BK status and then tell mil to pray the credit card did not have a $20K credit limit. Then tell her that was a $10K life lesson..
