Garnish from SS and/or Child Support


What is the name of your state? Idaho

Can a collection agency garnish the child support I receive? My only income right now is social security and child support. They have taken out the whole garnishment of $549.00. This has left me with almost $300.00 in bank fees. What about "disposable income?" Please help me.

Social Security and child support cannot be directly garnished. What apparently happened to you is a bank account garnishment. Unless you notified the bank that the money in your bank account is from exempt funds, it can be garnished. It is too late to get the money back but let the bank know about the source of the money in your bank account, that will prevent future problems.

Court for this garnishment


The collection agency is going to court over this on December 6th. I wrote to the sheriff's office that dealt with this garnishment and they set a date in court to dispute it. Am I still too late?
