garnishment both spouses???What is the name of your state? WI A few months ago my husband and I had a car repo'd. The creditor is now garnishing my husband's wages. Now today I got something in the mail from my employer that my wages are going to be garnished too!! Can both of our paychecks be garnished at the same time for the same thing? |

| Yes, because you live in a community property state !!!! Community property applies to debts as well as assets.. it seems too many residents of CP states don't understand that.

| OK, fine. I'm not arguing the fact that they are garnishing wages, but the fact that by state law they cannot garnish more than 25% of wages. If they are already taking the max amount from my husband, how can they legally take more from me? That would be more than 25% of our wages combined even. Please, no rude comments. I'm just hear trying to get some advice. I don't need to be criticized by anyone. If you knew the whole story behind the garnishment, you'd feel the same way I do. |
