Get proof of no debtWhat is the name of your state? Illinois I may or may not have an old debt in the form of a note. If there is a valid debt/note (note signed under false pretenses) I believe it has been paid off by other party (x-friend) who signed on the note with me. I have never made a payment on this “note” if there was a note I am 95% certain the note was paid by x-friend The “note” is about 4 years old X-friend is type of person who will make trouble, lie, harass me, or cause grief whenever possible I don’t want to have to deal with this person, and I won’t have to if I have proof of no debt or proof of paid debt How do I find out if I have an old debt? Are there guidelines if I contact the creditor (private individual) and making a demand for proof of debt? I have contacted the creditor (private individual) about debt and they said “don’t worry about it” not deny or confirming debt, which does me no good if they decide to take legal action. Do they have to be able to prove debt? If they don’t show me proof is the debt considered satisfied? |

| As they are an individual and a would be a first party collector, they have no real guidlines they must follow. They don't have to do anything really. If they try to collect, they would have to prove the debt. But depending on when last payment was made, SOL may have ran out anyway. I wouldn't worry about it until it came up.
