going to court in 2 days help


What is the name of your state (only U.S. law)? live in texas am going to court in 2 days. the credit card has been bought two different times. i have the check from my last payment. i have tried back in 2003 to send small payments they did not want it they wanted the whole thing. now iam being sued. scared to death. should i file sol or just take my lump because i read that texas law that they cant garnish my wages and take my stuff. or is it to late to do anything? can anyone tell me what to expect or am i goint to lose my shirt. i dont have the money for an attorney. so if anyone can please help me. i thank you

You waited too long to get advice, there is really nothing that can be done on such a short notice. The only real option you have at thi$ time is to find an attorney that will accept your ca$e on $uch $hort notice and can get a continuance. Gue$$ what you will need to make thi$ happen?

Why in God's name would you "take your lump" when you have a seemingly bulletproof discussion? You'd still have to deal with the ramifications of a judgment on your credit report and that could cause you all kinds of problems.

Come on man. Seriously.

File your answers in accordance with the rules of civil procedure of your court. Texas SOL is 4 years across the board.

OK, first time, let's see if we can help you.

First, why are you going to court? Since its a Monday, I suspect that you have an answer due on Monday (Monday is always answer day). Or have you been called to trial (often the courts say that trial is for the week or two week period starting on a Monday). Post EXACTLY what you were sent/served/received that makes you think you have to go to court and we can help you.

Second, what court is it? Small Claims? Justice of the Peace? County Court?

Third, have you been sent anything else from the plaintiff ... specifically, admissions, interrogatories or a request for production?
