Got a collection call at work!!What is the name of your state? SD "OMG! It was horrible. The collector has no idea what she was talking about." So AMO recoveries call about a $1,900 student loan debt. This loan was originally a Wells Fargo loan. Wells Fargo did not meet the demands of resolving the debt. Instead they were asking for payments WHILE I was going to school. Anyways, I graduated and cannot find a decent paying job. I want to work for a computer store and manage it just like my degree is in business. Wells Fargo decides to hastily makes a stupid decision to sell the debt off to a colletions agency. Thats thier loss. Now on to the AMO collections agency that was stupid enough to buy the debt. Lets buy the debt off of an insolvent person so we can be rich!!! Or s they think it will work. Why dont corporations do any research or think before thier actions? I mean how stupid can people be. Corporations are in the business of leeching off of unsuspecting consumers all the time. And in this case, its no different. Anyways about the collection call. This lady didnt even know a loan from an apartment building. I told her my income and expenses. $700 /month income. $575 car payment and $310 rent. As you can see that doesnt even make it. She even agreed that thats a bad income. But then she makes a hypocytical remark saying you can still pay the loan because it IS THE HIGHEST PRIORITY! I right then said to my self she had lost her credbilty as a collections agent for saying such an ignorant comment. She told me to use public transportation instead of having the car. I said to her " you listen here you little son of a *****. Dont you degrade me to some middle schooler who has to ask his mommy for a ride to work" You are promoting childish antics and I cant beleive you have obtianed such a job as you are in right now!! You should be terminated w/o a doubt for degrading someone who want to achieve a career in his life." Then she says that the loan debt was incurred before I got the car. WTF does that have to do with anything? I rent an apartment and thats debt too AND it was incurred after the student loan!! Now she just lost more credibility for bieng stupid. Student loans the highest?? Ok then. Take the car out of the equation. Lets work, pay rent, and then pay for the $33,000 total loan debt coming about $400 a month w/consolidations issued. Wheres the food? Wheres the trans? the phone? Wheres my family? I wonder if thier safe? Oh thats right, I should pay my student loans before I go to the grocery store to put food in my mouth. I told her countless times that I agree that the debt needs to be paid but I need the job to do so. But thier philosophy is to badger you for money. Its because of the "bottom line" business ethics. Which really isnt ethical anyway. I am an assistant manager and I know how the bottom line can screw customers over. When you are in the business of buying bad debt, you are taking an assumed risk. All corporations such as Wal Mart all the way to Chase Manhatten take risks going into business. And AMO isnt an exception. They were hasty in buying bad debt when they either knew I was insolvent or just was plain ignorant in doing any research before making such a transaction. Good luck in court!! I look forward to making the judgment in favor of me, well accually they will probably issue an extention like a forbarance. No one will win the case. I will have to pay it if I get a good paying job which doesnt bother me at all.And they called me at work which might be illegal?? Im not for sure... |

| What kind of loan was it? Not all student loans are deferred until you're done with school. You ARE going to have to pay this. And if it's already in collections, it may be too late for deferrment or forbearance. The time to get those was BEFORE you went into default. But if you think you're going to win if they sue you, you're kidding yourself. |

| My response: I love it when these deadbeats come here SINCERELY believing that their arguments not only make sense, but that the creditor should "understand" and wait. Quote:
Nobody cares whether you're a corporate CEO or a burger flipper at McDonald's. You pay your debts. Nobody cares that you have a family and need to house, feed and clothe them. So do millions of other people! Nobody cares, because it's completely irrelevant. You pay your debt NOW, or you get sued and the creditor TAKES it from you - - one way or the other. Geez, deadbeats sure can come up with excuses! IAAL |

| That may be the longest post of irrelevant, misguided nonsense in recent memory. It's a rant, probably because you're frustrated about the consequences of a problem that's of your creation. Because you put a question mark at the end of a declarative statement, is that supposed to make it your question? Do you care if they can call you at work and would it change anything? (Tell them in writing that it's prohibited and it will stop - it doesn't take a dissertation on American capitalism to get that answer.) Small hint: your attitude is likely to get you sued before the 10 debtors who were otherwise ahead of you, because two minutes of your venting and insults is going to convince the collector "lost cause - might as well go directly to litigation". You went to school to become this enlightened? And why you think you would win in court or that there would be "an extention like a forbarance [sic]" completley eludes me. Each day on this site, threads run that are directed to providing assistance in minimizing or resolving financial problems. But you're not looking for assistance; you're looking to instigate an adversarial confrontation, and it doen't seem to matter whether it's with the original creditor or with its collection agency/debt buyer. The unrelenting vitriol is amazing and makes me wonder why you took the time to post. I can't see the possibility of assistance. Your mindset is the only right way of thinking, and you're content to push problems into the future and deal with them when you must. Last edited by Chien; 03-28-2006 at 12:19 PM. |

| Here’s an intelligent mentality. Quote:
Without food, one risks death; loan doesn’t get paid. Without housing, one lives on the street and is dirty; loan doesn’t get paid. Without clothes, be filthy and stinky and will never find a good paying job; loan doesn’t get paid. Quote:
Jill has 700 apples and gives Peter 535 apples, leaving Jill with 165 apples. Suddenly Jill needs 300 apples to make a magical pie… how can one create 135 apples out of thin air? Some people’s mentality never seizes to amaze me! Quote:

My response: Oh, then by all means - - don't pay your debts. Creditors will "understand," and god damnit, they SHOULD understand!! Obviously, you're a Dufus. When you don't pay, you lose what you own, and what you will own in the future. That's basic Law 101. IAAL |

| I wasn't going to respond to the abject stupidity of the OP. But after reading Chaz'z addition to the thread, I am forced to make the following observation: There must be a God. I say that catagorically with no remaining reservation. Because it can only be through the intercession of a supreme being that humanity has risen to our level of sentience and still produces beings like chadro and chaz as you cannot simultaniously evolve into the top and bottom of the food chain. That said. Sell the car with $535 a month payment, buy a pinto and ask your college for a refund. DC

| Oh Chaz, you old shoe. I knew if you poached here long enough, you'd have to vent again. I bow to the poetic imagery of DC's response. Can't top that and won't try. But I have to tell you I'm delighted by the irony of the thread that you chose as your vehicle to give voice. Innocent debt collector does her job and makes legitimate suggestions to enable the debtor to address her obligation. Debtor verbally assaults her in the same way that you complain that debt collectors and corporate America abuses you. And this time, it's the debtor that you defend. I think you're envious. I think you only dream of some debt collector addressing you as "stupid little son of a *****", so you could dispatch one of your infamous letters to Mike Cox. Why care, Chaz? The OP says she doesn't. But if it is important enough to defend, then it should warrant sharing your wisdom too. OP, when they sue you, know your rights and keep records. Oh, and don't play with matches or run with sissors. And take heart; Chaz will counsel you through the rest. He knows because he has the same problems. We needed comic relief on this site. |

| Chaz - I felt slighted for a bit. A rejoinder to DC and Litigation! but not for me? Happy to see you're a gentleman and no shirker. My very own personalized repost! I'm sorry that you took offense at "old shoe". That was intended as a term of endearment. I've never believed you were old. Peanuts characters appear sage-like by comparison. I have come to believe that you like threads to drag on and on, even if they've gone wildly off topic, so that you can continue to post. With nothing of substance to add to the site, that's understandable, and I was going to ignore future threads and let readers draw their own conclusions. But I wouldn't want to do it with you thinking I'd been insulting (actually, I think you're pretty funny, in an odd sort of way). How about if I use "Son" or "Sonny", if I reply at all? I think probably "Son"; you might find "Kid" demeaning too. So, ok, we've handled the age thing. Now, to prove my sincerity, I'm going to do you an enormous favor. While you were composing for DC and Litigation!, I read chadro's 24 other posts and now I understand everything. (Well, almost everything - I'm still not clear on why the career jump from MacDonalds to assist. manager at a pizza shop required a new car, with the $50K in student loans still out there, but there's an explanation for everything and it's clear the college money was well-spent). She has been posting since 2001, and this girl is on the fast track. She's aiming for manager, if those pesky debt collectors will just sit still. So this is a favor for you. You have to hook up with this girl. I told her you'd counsel her, didn't I? I put the wheels in motion for you. She's as funny as you. So far, chadro only thinks the insurance industry is misguided and could use her business insights to get straightened away. With your help and guidance, she could expand her horizon to the whole Fortune 500. This is a match made in heaven, and it happened here. I see you two as the Jim and Tammy Fay Baker of your generation, and you might even avoid jail. No need to thank me, Son. And you have my permission to name the first-born after me. |

| Sorry, but I have to agree with DC here -- and others. The OP makes $700 a MONTH and he's got a $575/mo RIDE ?? Good grief. Dump the expensive ride and buy something you can AFFORD until you find a decently paying job. You're fresh out of school, stop whining and waiting for your 'dream computer store manager' job and FIND SOMETHING ELSE until what you want comes along. Quite frankly, that's a fairly LOW goal IMHO if you've got any kind of decent degree at all. Guess what.. business in the REAL world is NOT like what your textbooks said and banks and the collection industry make BILLIONS going after people like you. Is it fair ?? LIFE is not "fair" and THEY DO NOT CARE and they do not have to. Collections is black and white -- you owe, you must pay, no matter what. If you don't they can sue you or just take a significant chunk of that $700 income in garnishment. The back story of your travails means nothing. The student loans will follow you to your grave - literally. They cannot be discharged in bankruptcy AND the Supreme Court ruled that even Social Security can be garnished for unpaid student loans.

| LNR - Trust me. This one is not going to take anyone's advice, if offered. Read the other posts - they tell the sory. She knows the answers and everyone else is clueless. She once had two cars (?), but there were "accidents". (One where her boyfriend put the car in gear and smashed the car ahead while sitting in the passenger seat is especially poignant.) An assistant manager job at $7.15/hr. as I recall, necessitated the purchase of the new car at $575/mo. because she's "on call 24/7". Apparently, pizza is a high risk, stressful business in SD (I never would have guessed). She has monthly income of $700/mo. and car and rent alone come to $185 more than that. She's obviously going backward there too. Car sounds better than the apartment. maybe she should get rid of the apartment and live in the car. One assumes that she lives exclusively on pizza. Maybe fashions clothing out of it too. God knows what she does about insurance, but she had Senior Judge talking to himself with her explanation of how her auto insurnace should have been priced and apportioned. Her posts are a hoot and your intentions are good, but this post that should be put to a quick and merciful death, not given encouragement to drag on. |
