Guarnish Wages


What is the name of your state?What is the name of your state? Colorado
I have Writ of Continuing Garnishment on individual working for Southern Ute Head Start Program. The Ute Tribe's attorney wrote me letter saying they will not be answering the Writ of Garnishment for that employee saying that the state courts lack jurisdiction to order garnishment of employee's wages. The employee is NOT of Ute decent. The employee did not indicate any other assets to attach. What can I do to collect the money due?

The tribe's attorney is correct, they do not have to honor the garnishment. Remember, Indian tribes and reservations are a sovereign entity and are not subject to local and state laws. You will have to get your judgment domesticated by a tribal court to enforce the garnishment.
