harrassing phone callsWhat is the name of your state? missouri I am recieving phone calls from a bank up 8 or more times a day, some of these are after 9pm at night. I have been working with a seperate person at this bank, but they have an automated dialer system and it isn't working. There is never anyone on the other end of the line when I answer. I have told them about this and they insist that it isn't true. I cannot get it to stop. Do I have any legal rights as far as the phone calls go? I don't mind talking to them, but I do mind getting calls with no one on the other end. thank you |

| You are getting calls that the bank says they are not making. One of the hardest things I ever tried was to convince a monolithic organization that their computer was messed up. That is your problem. You can sue. to sue, you must be able to prove the calls. If you go to all that trouble, you could convince the bank of the problem. Some alternatives. 1. Ignore it. It is annoying but that is all it is -- annoying. If this is the biggest annoying problem you ever have, consider yourself blessed. 2. Document it. If you have caller ID and a camera on your cell phone, take photos. Show them to the "dialer manager" at the bank. 3. Change your phone number and don't tell the bank the new number. 4. Talk to the phone company. See if they have the ability for you to block certain numbers. |

harrassmentOk, I did get my cell company to block the calls for 60 days, and I can have it reinstated if I need to, but back to my original question, how many times are they allowed to call? I would think there would be a limit. And where can they call, technically my cell is also my work number as I am a self employed truck driver. Also I suspect they have called my parents home. (they are going to start *69 the calls to get proof). I don't think this is legal by any means. I am certainly of legal age and not under my parents guardianship. so what about this deal. thx |

| The unfortunate reality is that they are not doing anything illegal. Unless their claim that you owe them money is not meritorious, they have a right to use the telephone to contact you and collect. There is no law that I'm aware of that mandates that they have a live person on the other end of the call. The poster who suggested that you might have a legal claim may be correct in some limited sense, but I doubt that any such suit would go anywhere and would cost you more money which you may not have. |

| If you are dealing with the ORIGINAL CREDITOR, then they are not bound by the FDCPA and are therefore not subject to it's limitations. That means they can pretty much get a way with anything. They put these things into an auto-dialing system. If they do not get a person to answer and actually speak to someone, then it goes back into the auto-dialer. Don't you think it would be prudent to talk to the bank to do something about the issue ?

Debt Collector Calling Wrong Number- BUT WON'T STOP4) Texas: Debt Collectors Harassing My Home - Wrong Number! What can I do to file a harassment lawsuit against a debt collection agency? Who can I contact to file criminal charges and complaints against this operation? A particular debt collection operation has called my residence at least 10 to 20 times per month over the past 8 months looking for someone I have never heard of in my entire life. Their incompetence and desperation for revenue runs so deep that when they skip-traced for the person they are trying to reach all they saw in the phone listings was a first initial and a last name and assumed they had the person tracked down. My number is listed as just a 1st initial and last name and no address. At least 5 to 8 times a month when I am working from my home office and can answer the phone, I tell the representative that there is no one by the name they are seeking at this number. I even call the number on my Caller ID and attempt to reach a manager or supervisor. I have spoken with supervisors on 4 separate occasions. I am told each time that the number has been removed from their records. Their lie is short lived and I continuously get harassed with more phone calls by extremely rude callers invading and interrupting my private residence and family. I should be compensated handsomely for the stress, damage, and invasion into my home! |
