help(NH)In 2004 my brother drove my unregistered car(I was in the process of transferring ownership to my mother) without my permission. He was in an accident. I had no prior knowledge of his drive nor did I hear about his accident till several days after it occurred. The car was totaled. I told him to junk the car. He informed me it was "all set". When the car was totaled it was towed. He neglected to pay the tow company or the garage. The transfer of ownership was never completed as i was under the impression the car had been disposed of. The car has been at the garage since 2004. I had no knowledge or personal contact with the tow company or garage. I recently received a lawsuit for services and storage of the car totalling 2300. i agree the garge deserves payment but it seems to me they are going after the wrong person. Please advise. |

However, if you are in fact the registered owner of the vehicle, their suit is correctly named. You will have to either add your brother to their suit (3rd party) or have to file a separate suit against him to recover your 'damages' (the amount you have to pay due to HIS accident). Your verbal agreement to 'junk the car' and his claim it was done... is NOT really relevant.... and virtually unprovable.
__________________ There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution). Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport! |
