Help, Being sued by creditor


What is the name of your state? FL

I have just been served and am being sued for an old debt. I am due in court on November 7th 2007. I have an old credit card debt with Providian National Bank. They have turned the debt over to Pallisades collection agency. This debt was turned over to them in August of 2003.

I have been trying to find out if this debt is out of the state of Florida's statute of limitations. Some sites consider this an open debt, others do not. Some say 5 years, some say 4. It's very confusing to someone who does not know the laws.



If anyone can help me I would appreciate it very much. Time is running out. Mediation is next week.

1). I don't have the money.
2). I lost my job recently and am unemployed and searching for a job.
3). I HAVE three children to support.

the problem is you arent disputing whether or not you have a debt, you just want to get out of paying it. it is your debt. call them and try to work out a deal.

How do you make a deal with a creditor if you don't have the money to pay the debt? I don't understand some of the answers here. The OP said they did not have job, had 3 kids and didn't have the money to pay.

It seems to be all about LETS'S MAKE A DEAL. What kind of deal would that be? In the first place the interest that the collectors and creditors are allowed to charge are OBSCENE and should be against the law.

My advice to the OP would be this: If you can't pay it, you can't pay it. I don't know what assets you have, but read up on what is exempt in Florida. Protect your a-- because nobody else is going to do it for you. You have 3 kids to feed and that is priority - not the stupid creditors.

then maybe if he doesn't have any money and can't make any money, he should be out creating debts he can't pay and making children he cant afford?

Oh, excuse me, I didn't know that you walked on water. Who are you to sit in judgement of anyone else? The poster asked about SOL. They did not ask for nasty comments and criticisms.

You have no right to make nasty assumptions about anyone. How would you like it if somebody did that to you?

I thought this board was about legal advice, NOT about judging people you don't even know. If you have nothing to offer the person in the way of advice, why did you post at all (just because you felt a need to make a snide remark?)

I guess you don't know what it is like to have your husband walk out on you and lose your house & everything in the divorce.

When you are swamped with bills...have little income and have no choice but to run up your credit cards to to keep the lights on and food on the table.

Sometimes you gotta do what you gotta do. Obviously, I didn't know that this was going to happen to me until it was going down.

So judge me if you will I guess.

All I wanted was advice. Instead I get criticism.

I gave advice, call the credit collector and try and work out a deal, you didn't like the advice. sorry.

and don't assume you know anything about me either, I was divorced in June of this year after 12 years of marriage.
