I have a judgement creditor that had the Sheriff serve a Notice of Levy Writ of Execution (Money Judgement) for "any and all monies due and owing" addressed to "tenant" at my primary household where I reside.
They obviously are assuming that I'm a landlord and rent my house and are trying to collect any rent from tenants that would be paid to me to satisfy the judgement.
Since, there are no rents from tenants to garnish and primary dwelling's are automatically exempt from this type of collection action, do I need to do anything about this? Should I go through the trouble and expense of having the Writ recalled or quashed as defective? I'm not denying the debt I just can't deal/pay it right now?
