Help with contract lawWhat is the name of your state? Michigan I have a question and cant seem to find an answer anywhere. in June of 05 my husband was at work and a door to door salesman came to the house offering to install an alarm system for free with a two year contract. We did not own the house at the time but the salesman said it was fine and out the contract in my husband name and had me sign his name. I wrote a check for the monthly installement for monitoring and agreed to have them debit my account each month for the monthly monitoring fee. After about 6 months we realize that the alarm system that was installed was a peice of crap and kept sending out false alarms and the company was charging us a 45.99 fee everytime they had to come out. When we closed our checking account we used to pay them I let them turn off the alarm and hadn't heard anything from them until now. They have a debt agaency after my husband now for the contract that I signed. And they are trying to garnish his wages for 2000.00 for the remainder of the contract. There is no driver license numbers on the contract it isn't even intial properly and again I signed my husband name he was at work at the time. So my question is can they hold him to a contract that he never signed? I really need some help on this matter and would apperictae anyone who can ellaborate on what i should do next. I have sent the company copies of his driver license and they reconigne that his signature doesnt match but have the check I wrote the company and said my signature matches his and still want him to pay. |

| Are you trying to prove there is no valid contract because you committed fraud? Pay the money. You don't want to go there when, at the end of the day, you will be responsible--or your husband on the theory of agency.
