Hippa violation/discrimination


What is the name of your state? Colorado

One cancer treatment provider /collection agency reported a debt to my credit report clearly identifying it as medical. This disclosure alerted potential employers who use credit reports in background checks, of a recent medical condition. I feel my right to medical privacy has been violated resulting in hiring discrimination.

You should have paid the bill and it wouldn't have showed up. Just because you may owe "The Women's Genital Herpes Clinic", can be argued that you don't necessarily have to be a patient. You could have been driving down the road and lost control of the vehicle and busted out the mailbox or front door.

Thank you djohnson for the response. My concern is not that the debt was posted (although the collection agency made a written agreement with my attorney to wait 30 days but posted it anyway) but that the posting was labeled "medical".

seniorjudge: I really appreciate your insight on this. You asked, How was my privacy violated resulting in hiring discrimination? The collection agency labeled the collection as a medical debt. The label indicates the possibility of an illness. A potential employer using a credit report as part of a back ground check could easily use that information to eliminate an applicant. Consider there are two candidates for one position. All things are equal but one has "medical debt" on a credit report. Who would you hire?
HIPPA is intended to protect us from such discrimination. What benefit is the Medical label other than to convey my state of health?

Sir; a note after your signature mentioned something about barking at people not in agreement with my response. I hadn't made any response other than my initial post and did not intentionally bark. I do appreciate your insight. Please accept my apology.



You weren't barking...read my signature again.

In any event, I am hearing you say that you have NOT been discriminated against but you think you MIGHT be discriminated against in the future. Is that right?

I don't know why anyone would discriminate against you because it was a medical debt; some people may discriminate against you legally by not wanting to trust you with money in their business. But it wouldn't have anything to do with health.

Have you read the hippa laws as they pertain at all? in no way does this violate the hippa privacy laws. If you would have made acceptable arrangements to pay the debt this never would have been posted to your credit. Your actions brought this about, and unless it specifically states who the creditor is such as cancer treatment centers, know one would know that you have any medical condition that differs from you slamming your hand in a car door and being seen for it.
