how to counter sue against court judgement?What is the name of your state? Nevada. I recently had two business bank accounts frozen by a local collection attorney hired by the yellowpages to collect on a prior ad that I have been paying on for two years, and missed a payment in Dec 2007. The attorney had the court award a 4500 interest penalty on a 5000 balance for one missed payment. Can I counter file against this action, and how do I do so? |

| were you not a party to the action that allowed the interest charges? Were the interest charges allowed per the original order in such a situation?

| it would depend on how the interest was awarded. If it was awarded in a seperate suit and the OP was not served properly, then obviously, due to defective service the judgement could be set aside. as well, on the face of things, it would appear the interest was usurious and as such, could be contestable. Depending how the amount was determined and what action allowed the interest, it may be contestable. I'm just grabbing a couple things due to the serious lack of info but there is a start.
