How do I stop her bankruptcy from including my judgment?What is the name of your state?What is the name of your state? Indiana I have a $1500 judgment against a person I loaned money to. Last month I got a judgment to have her personal property seized and sold at auction. Today I got papers saying that she is filing chapter 7 bankruptcy. How do I stop my judgment from being included in her bankruptcy? |

| Forget it .. you can't stop her. You can file a proof of claim and show up at her 341 meeting, but its unlikely that you'll prevail on an unsecured debt, even if you have a signed agreement from her.

| Her husband co-ownes a construction company and I found out yesterday that he has a bank account with over $10,000 in it but doesn't have her name on the account. This is not a company account, it is a personal account. Is there any way I can use that to fight her filing? |

| Fuhgetaboutit. As of this moment you cannot do a thing. Nothing. Nada. Any attempts to collect will land your butt in federal court looking at some stiff fines. As Ladynred already told you, there is nothing for you to do but wait for the 341 meeting, it will be in about 90 days. And your odds of getting anythign is very slim at best. Then you can plead your case. And forget about the husbands money. You have absolutely no legal right to claim a penny of it. The good news is you can write the debt off on your taxes.
