How long can they wait to send a medical bill?

What is the name of your state (only U.S. law)? Michigan

We just received a medical bill that was never sent before and it is 3 years and 1 month from date of service. If this had been sent in the year it happened it would have been covered by our out-of-pocket maximum. The insurance company was billed and we paid a part of the cost in 2009. Can they wait this long to try to bill us? I don't even think we have our medical records from that long ago anymore.
