I received a Summons.


What is the name of your state? NY

I received a summons stamped March 18, 05 from CACY OF COLORADO, LLC. The attorney representing them are DANIELS & NORELLI . They say it CHASE MANHATTAN Bank they respresent. At the defendant(s) request, the original creditor issued credit card account to the defendant(s) under a retail installment credit agreement by which the defendant(s) agreed to pay for merchandise, loans and installments, and in the event of default, to pay reasonable attorney's fees. The defendant(s) or authorized members of the family, received cash, merchandise and/or credit on
the credit card account and there is presently an unpaid balance due and owing to the plaintiff in the sum of $2.140.02, with interest from 08/15/04 and said defendant(s) is now in default of payment under the terms of said agreement. together with reasonable attorney's fees.

Payment of the defaulted balance has been duly demanded and remains unpaid.
A copy of the credit card agreement was mailedor delivered to the account holder.
That there is now due Plaintiff from Defendant the amount 01'$2,140.02 no part of which has been paid. although due & duly demanded.

My question is this. I am unemployed right now, and just gave birth to my daughter 3 weeks ago. I have absolutely no income, and am living at home with my mom. My mom is all ready paying my car payments because she's the co-signer. In time I do plan on declaring bankruptcy, however I cannot so right now because I have no income. I have no idea how to respond to this summons. I have tried talking to them but they do not wish to listen to me. Any information you could provide would be very helpful.
