I sent them a settlement offer and they responded by serving me with court papers


What is the name of your state (only U.S. law)? Washington

Around the 1rst of the year I noticed an inquiry on my credit report from a company called Credit International Corp. They did a hard pull. I did not know at the time what this was in regards to but none the less I googled them only to learn that they are sue happy

A few days later (1/07/09) I get a dunning letter from them. The debt is mine so I sent them a settlement offer. I sent it CMRRR. They signed for it on 1/12/09.

For a response they send me court papers. I got served today. The papers were dated 01/19/09 if that matters.

I would like to keep this out of court and I did make an offer in good faith to settle this. I could pay in full but I was hoping for a deal.

Now of couse even though it's only been a few days they have added an extra $141 in fees

Anyways if I call them on Monday and tell them I will pay in full do you think there is any chance of this staying out of court and off my credit report. Currently only the inquiry is listed.

First, I think we can assume that they didn't like your settlement offer.

Second, if you are going to pay it off, that should keep it out of the courts.

I do recommend a little horsetrading here. Offer to settle for half and let them counteroffer. No, you won't end up paying half... but if you can get some of the fees and other junk removed and only paying your original debt, that would be a goodness.

I agree they SOO did not like my offer. I will call them Monday and see what kind of offer I can get. Any deal would be better than nothing. I could make a payment right now BUT there is no way they are getting my credit card or bank info I will send a money order.

You will get a better deal if you use a credit card... and a record of the payment if you need it later.

They want money TODAY... and are willing to pay for that immediacy.

You could and should then call the issuing company and tell them that you are making a single charge to this company and that you will not accept any others. Depending on the company you use, that should prevent them from being cute.

DO NOT use bank info or a debit card. You will not be able to dispute a charge made outside of your agreement as easily.

Just to add:

Make sure you have written confirmation of your settlement BEFORE money changes hands. Have them fax you something - then you pay.

How should/will this show up on my credit file?


So I contacted the people suing me today and was told that if I pay in full plus all costs they will drop the suit. I agreed to pay in full as it is my debt and still just with in the statute of limitations.

I will not pay in full until I get something signed from them that they agree to drop the suit and they know that.

I asked about my credit report and they said they would update it to say paid in full. The thing is there is nothing other than an inquiry dated 12/29/08 from this company on any of my reports. They claim they reported to all 3 bureuas in November. (the inq only shows up on transunion)

Anyways so this probably will show up. If it matters I can prove it was not there before as I have copies of past reports. If it does show up how should/will it show. Will it still show up as a judgement seeing that it's not actually going to court?
