If SOL expired, how do you remove listing from CR?What is the name of your state? NY If an account has had no activity (payments) past the SOL (in NY it is 6 years) how do you remove the item from your credit report? The credit report has also listed the debt as "date placed for collection" and "date updated" years after the original debt/last payment was made. If anyone has any information, I would greatly appreciate it. I have been trying to clean my credit up for the last couple of years in anticipation of buying a house in the future. | It can still remain on your credit report for 7 years plus 180 days past the original default date. This has nothing to do with the SOL. The date updated also does not matter, this is just the last time they reported any changes to the CRAs. This has nothing to do with the default date and the 7 year time limit for it to come off of your report.

| I also live in NY and I have an account on my credit report and it says account clsoed 8/99, updated 2/2002 and another one says closed 8/200 updated 6/2001 I am trying to figure out how long they'll be there, if the SOL is up for collection activity (or if I should pay).... I too am looking to purchase a home and trying to clean up my credit - you sort of hate to pay something that might be over SOL and about to fall off your credit report, but on the other hand****************************...... I am going to watch your post - I wish you BEST LUCK !!!!!!!!! This site is SO helpful and I am so glad I stumbled on it (google) I have learned so much!!! |

| You can try the 1-2 punch. Send a letter to the collection agency, certified mail return receipt, asking for validation. When you get the green card back, send a dispute letter to the applicable credit bureaus, certified mail return receipt. Dispute the tradeline as "not mine." This puts the CA on a 30 day timeline. They have to provide validation to you before verifying the tradeline with the credit bureaus. This has worked successfully for many people, but it is not a fool-proof method. |

| The date the account was closed doesn't mean anything in terms of the SOL for legal action either. You want to look for the 'date of last activity', which is usually the last time you paid. 30 days after that would be when it went delinquent and THAT would start the SOL for legal action - and the reporting period too.

| so it should be fairly safe to assume the DLA was PRIOR to the account closed date, right? I am trying to figure out if I should bother with this account. DLA is MY last activity date, right - not someone (CA) elses? Thanks!! |
