What is the name of your state (only U.S. law)? Texas
Hello, I purchased a car from California in 2014 and I have been making my payments on time since I had it. I moved to Texas and can no longer afford the vehicle. I contacted the lender to do a repo in August and today their not willing to pick it up and their going to sue me. Can they do that if I'm volunteering to give the car back?

Yes, they can do that. They have no obligation to accept a voluntary repo and they can certainly sue you if you don't pay.

Whether they actually make good on their threat is anybody's guess.

You'll have to stop making the payments to find that out.

By the way, a voluntary repo is still a repo and trashes your credit just as badly as an involuntary repo so there is no advantage to you.
