I've been served with a summons. Help!What is the name of your state? I live in California and I was served with a summons for an old debt. The original company transferred my debt to another lender in August of 2002. When I recieved the summons I called the new lender and tried to settle for less than what they claimed I owed, but no deal. Can they sue me if they weren't the original lender? Can they sue me without having any information as to my actual purchases (it was a credit card). What is a "request for entry of default"? What are my rights? Thanks! -amy. |

| Yes, they can sue you if they are not the original creditor, and no, they don't need proof to sue you either.. unless you MAKE them produce it. You say this debt is 'old', HOW old ?? When did you last pay the original creditor on this debt ??
