Judgement


What is the name of your state? Texas
a couple of years ago had several mishaps occur in my life that caused me to get behind on credit card payments (won't bore you with my sob stories). I tried to work out an alternative plan with my debtor's but they were unwilling to work with me. i had a choice as to paying them or eating and keeping a roof over my head and I chose the latter. I know the debt is my responsibility and I did not take out the debt with the intention of not paying. I just had to choose whether to pay them or be able to have a roof over my head and food on the table. Now, one of the credit card companies that I owed $2900 to has had a lawyer calling threatening to sue me and place a judgement against me. I know they can do this, but why threaten me? Why don't they just do it? If they do, how will that help them get their money? They have called my employer, my mother, and I expect to find them hiding under my bed at any moment! The person I talked to called from a cell phone (I did a reverse lookup) and she was threatening, telling me she knows everything about me and that she knows I have real estate (I do-a matter of public record, but owe more on it than the market value). She asked if I had a bank account. I told her I have $50 right now, but did not say I had a bank account. At this point, I already have more going out than coming in, I live very frugally (no eating out, no buying clothes or shopping, no SUV, no trips, no furniture except a bed and dining table, a desk and this computer, and a TV), so I have nothing to give tham that will pay the debt. I have offered payments in the past, which they have rejected as not being enough. I have my pay check direct deposited to my bank account, but it is all gone by the next day. Can they get in there on pay day and take all my pay every pay day? Does anyone know? If anyone out there knows if they can take a lien against my house too, please let me know. I know there are those out there who think I'm irresponsible and a reprobate for not paying my bills and maybe I am. But at this point, I am just trying to stay alive and survive without losing what little I do have.

They can Garnish a percentage of your wages every week. They can freeze your entire bank account, and they can put a lien on your house.. Now this is in most states, not sure which of these apply to your state. There are people here familiar with laws where you live, so watch for their post. Try to work out something with payments if you can, if not dont keep money you dont want to lose, in your bank account.

You're right. You don't know Texas law.

Come to South Carolina. They cannot wage garnish here. They can get a judgement but it is gone in 10 years so if you have no intentions of moving, don't worry.
I recommend you keep a list of who you speak to, what you offerred that was turned down and all the threats they make. It is illegal for them to threaten you.
