Angry

Judgement for Money entered, but I told them it wasn't me!!!

WI

Hello, I have had an on going problem with Law Enforcement, and debit collectors for years, because someone with the same name as I is an unsavory character. I have always explained that it is not me that owes the money, or trashed someones house with out issue. This latest problem has gotten way out of hand. I received a letter months ago from a law firm looking to collect on a debt, I told them it was not me, and gave them the last 4 digits of my SS#, just like I always have. Then I received a notice to appear in Small Claims Court for the same issue. I again called the firm, and was told to ignore it, becuase nothing would happen if it wasn't me/my SS#. Today I received a Notice of Entry of Judgement. So, yes I am now angry, and call yet again. I was told that there is nothing that they can do to stop this action, and it is now MY problem, and by law in the state of WI anyone and everyone, with the same name as mine will have a lein put against their property, no problem, they say, I'll just need to file an affidavit when I want to sell my house. Is that a true statement, that everyone named say Jane Doe, will have a lein placed against them? How did this get so far, when I told them months ago this wasn't me? How do I stop this from going any farther? After talking to the, oh so rude, people at the collection agency/law firm I have zero confidence that I won't find up being found in contempt of court.

Someone thought I was Anna Nicole whatsher name? Anyway.. The debt collect people are finally off my back. sad way to have it happen.
Sorry way to have it happen though. but I don't know how the mix up came up. I look nothing like her.

I look like Howard Hughes, same legacy perhaps. I don't get many letters much though since I sicced my new cat ( DOG?) thug on my hunka hunka new postman Doug. They are thinking of putting robots on my block? could it be me? Nahhh.

I think your problem is that you didn't go to court and the collection agency got a default judgment. You will to go back to the court and appeal the decision.

I was told by the firm to ignore it, and that nothing would happen, because it wasn't me. It was small claims court. Now the paper works says I need to pay in full, or give said 'law firm' a Financial Discloser Statement in 15 days or I 'may' be held in contempt. I was told agian to ignore this by the people taking my calls at the firm. I'm still not sure how it got this far, when I told them months ago it wasn't me. Long before I got the papers about Small Claims Court.
It says nothing about an appeal process

What makes you think you should take legal advice from a collection firm? And, what makes you think you should take legal advice from your adversary?

I know, I know, I know.....

I had no idea they were my adversaries. Did I fail to mention that this is not my debt, never was my debt, that I'm not the person they're looking for? I have been getting calls likethis for years, and it has never come to this. It seemed perfectly clear to me that they understood that, and still do for that matter. I can see know, that clearly I have made a mistake, but the question remains, what the heck do I do now?

Your are going to have to go to the court and try to get that judgment set aside unless its too late. But now the court has entered a judgment against YOU and the time for dealing with the collection agency is over.

Since you already have a judgment against you, you will have to go to court & appeal the judgment decision.

So the judgement is against me because they have my name and address? I was told, I know by the collection firm, that it wasn't because it's not tied to my SS#, but this other persons that has the same name, and bad credit too boot.

Thanks to everyone that has replied.
