Judgement proof?


State of Illinois

Preparing to sue an individual/ small business owner in civil court. While I'm more than confident we can get a judgement against him, I'm concerned that he may claim to be judgement proof, and I won't be able to collect.

He owns no property or house. He lives an extremely simple, thrifty lifestyle. He does earn a fairly good wage however Works constantly and charges $50/ hour for his services, He's owned his business for over 15 years, and never filed bankruptcy. He's self employed. Don't know where his $$ goes,

Any thought, based on what I've written, if this guy sounds like he's judgement proof?What is the name of your state?

Not a chance is he judgment proof. He can say it all he wants -- but the money is there, according to what you posted.

DC said it. No business operating is judgment proof. The problem is with creditors who don't know how to collect. Take it directly from the register. If there no register, take it directly from the customers. You just have to learn how. He's not living on air.

you can file judgement ,and if he acquires anything in the future it can be yours...no one is judgement proof......

I agree.. not a chance he's "judgment proof", few people are.

In addition, because he IS self-employed, his income is also in his receiveables and as such you could attach ALL of that -- not just the percentage usually garnished for typical employee wages.
