Judgement QuestionWhat is the name of your state? NC Hello all, I have become very desperate in seeking a resolution to a problem I have. I lived in an apartment in NY and left in January of 2004. The apartment managers placed a judgement on my credit report for rent for 4-5 months after I left. I wrote letters to the lawyers that were handlling the case which included photo copies of my new lease and utility bills . They never responded or removed the judgement. The judgement is for over $ 8,000 and this has become a horrible issue especially since I am moving and no ne will rent to me. Can any one offer me some advice on getting this issue resolved? |

| Not much advice, because you broke your lease and did not pay your rent. Pay the judgement. Just because you are showing a lawyer that you are paying rent elsewhere means nothing. You left them high and dry. Don't you think they deserved to be paid?

The apartment managers could not place a judgement against you without first taking you to court. Do a search on the county website or go down to the courthouse and retreive the file. I would look at the method of service. The way you describe it is you did not know you were sued. You may have grounds to have the judgement vacated due to improper service but there is usually a time limit for that. Bear in mind though that if you are granted a MTV due to improper service, the suit could be refiled. It all depends on whether it is vacated with or with out prejudice. Sounds to me like you are going to need to pay up regardless. |
