Judgement Reversal?


What is the name of your state (only U.S. law)? MN

About 5 years ago my sister's fiance had a car repo'd. The lender's came back after him for the full amount of the loan after the car was repo'd. Over the phone he was told he still owed 5k. He agreed to a payment plan.

Earlier in 2008 the payments stopped so he was done paying it off. 6 months later he got another garnishment on his paycheck that simply stated RIT for $325.00, turns out the company went back to court and got a judgement against him for another 6k for their "court costs and fees". He was never served papers or anything so this is all out of the blue.

He requested copies of the documents to prove all of this and it turns out that everything they had they sent directly to the corporate office of his place of work and didn't have his name on any of the mailings, only his place of work.

What can he do? Since they never served him can he file an appeal to get this judgement overturned? Does he need a lawyer to do this? Does he have any options? He tried to get them to agree to a lower garnishment but they said they will not, they want their money now.
