Judgment Filed After Receiving 1st Payment


What is the name of your state? ::CA


Island National Group is the collection agency assigned to my macy*s account. I received a settlement letter from them in July outlining different payment options to clear my debt of $610.00. I chose to pay the balance in full over 3 equal payments and in turn after the balance was paid in full, they would reinstate my account with macy*s. I sent an immediate payment for the first installment which has already been cashed, the second check was sent on time and cashed, the third payment is due on 10/8. I checked my credit report today and discovered that macy*s filed a judgment against me for $407 dollars. I'm assuming that this was done immediately after my first payment was received. I plan to make the final payment 9/29 which will satisfy my obligation with them according to the settlement letter that I received.

Can macy*s file a judgment against me even though I entered into a payment agreement with their collection agency? Will the judgment remain on my report after my final payment has been received? How can I get it removed?

If all your going by is your credit report, then you have NO IDEA whether or not there is a judgment. For $610 it's unlikely you'd be sued, especially since you did make payments for most of the amount. There are some collection agencies out there who use the nasty tactic of reporting a debt as a judgment WHEN THERE IS NONE !!!

Call your local courthouse and ask the court clerk if any lawsuit and/or judgment has been filed against you. If you've moved since the debt was incurred, call that courthouse too. Just do NOT go by just your credit reports.

Yes, but it's not likely. You would have to have been served with a Summons and Complaint, been required to either file a written answer or go to court. The whole process would NOT have been a surprise.

Call the courthouse tomorrow and get the TRUTH. Then worry about disputing what's on your reports.
