Judgment info request


What is the name of your state? North Carolina
I recently was contacted by a collection agent regarding a judgement filed against me for money owed to an apartment complex. I cosigned a lease agreement for my daughter and she (we) apparentley defaulted. I never received any notification from anyone prior to getting contacted by the collection agent. Should I have been served some paper prior to turning the debt over to collections? Any info on this would be helpful...thanks in advance.

What was the address you had on the lease?

That is where you should've gotten the notification of suit.

Are you saying you don't know if you defaulted or not?

If there really IS a judgment against you, then you most certainly should have been served with a summons and complaint. WHERE they served it is another question. My suggestion would be to call the courthouse and find out if any lawsuits were filed against you/your daughter and then ask for a copy of the case file. In the file will be a proof of service that will tell you when, where, how and to who the summons was served.

Next question, how long ago was this lease supposedly defaulted upon ?

Here's the deal ...I cosigned for an apartment for my daughter...she moved out to another location (June 2004) . In december 2004 I got contacted by a collection agent and was informed I owed money for a default on the apartment. I pulled a copy of my credit report and found the judgement listed. In Dec 2004 I negotiated a settlement with the collection agent to pay the bill. I don't dispute that we/I owed the money. My question refers to the fact that I was never notified by anyone and given the opportunity to take care of the debt before a judgement was filed. Is this the way its done and if not if there any means to get the judgement removed from my credit report.

No, you would not have received notification unless your daughter gave it to you. She screwed you.

The judgment was given when the eviction was done.

You're just going to have to pay it.

Credit card judgement


I've had a problem with dicover and with an on going dispute for a few years. They have now finally aguired a judgement against me over a telephone hearing without my knowledge. Is ther anything I can do and if not what options do theyt have in collecting the so called debt.
