just served

What is the name of your state? CT

I got into some credit card trouble and we over extended it and could no longer keep up. We looked into a credit consolidation company but the payment was not in our favor. We signed up with a debt settlement company and I have not paid a payment on my cards in about 4 months. I was served today to court in may. A popular bank is suing me with a local laywer as their representative.

What can happen to me? Worst case, best case?

Judgment against you.

There is no 'best case'. What will happen is they will get a judgment against you and then using it, start seizing any non-exempt assets that you have. Also, you are going to take a substantial credit hit.

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Stop putting money into a bank account for one. If you happen to have a bank account where your checks are deposited automatically, you are gonna get "screwed" cause they are going to take any money from that bank account. They will garnish your paychecks. Get ready to have no money. They can put liens on your car and house.

I would suggest seeking advice from a consumer based web site. Someone who has been in your situation and got good results.

Most of your answers can be found by googling: credit info center. Tons of consumer information regarding very possible kind of debt. You can find people who have been in your situation and will give you advice. Plus they are really helpful there!

I found a list of exempt/non-exempt assets from the CT General Assembly website:

http://search.cga.state.ct.us/dtSearch_lpa.html

Search Chapters 903 and 906 for pre and post judgement remedies and procedures

Hope this helps!

Of course it doesn't help.... since you link is to a search site that provides NOTHING to the poster.
So, with that....

To the poster:
The link to the actual statutes (that you can review) is at:
http://www.cga.ct.gov/2007/pub/titles.htm

You want to look up 'Chapter 906, Sec. 52-352b. Exempt property.'

Always a prick.... to those who make posts on this LEGAL ADVICE forum that are inaccurate or could harm the person asking for help. I do not tolerate stupidity or incompetence.... both of which you suffer from.

Thanks everyone, I have hired a lawyer and I hope I am going the best route.
Being sued for 1 card I am sure many more will join aboard which will result in a wage garnishment and possibility of loosing my home so I am basically forced to do a chapter 7 bankruptcy.
Darn ecomomy!
