lawfirm attempting to collect a debt


What is the name of your state (only U.S. law)?
I live in New York State

A law firm is attempting to collect a credit card debt that was discharged in my husband's bankruptcy in 2005. Our lawyer told us to request a copy of an original document which proves my legal responsibility for this debt. The only thing sent to us was copies of credit card statements which show the debt as charged off and a $0.00 balance. I sent a legal letter disputing this debt last Oct.(08) and I am receiving phone calls again from the law firm claiming I'm still responsible.
What are my rights?? I do not believe I am responsible for the repayment of this debt. What can I do??What is the name of your state (only U.S. law)?

Was your name ever on the account? If it was, you can be held liable.

If you can prove that it was discharged in BK, you have a defense in court.

No she dosn't, she is not the one who filed bankruptcy, he is. The debt was dsicharged as to the husband only, if the CC company says she owes she could be liable.

Lawsuits are not about justice. They are about MONEY. If you don't want money, then you shouldn't be thinking about suing. And people post here because they are thinking about suing. Because they want money, no matter how much they don't want to admit that to themselves.

so, to make a reasonable guess at an answer we need to know:

the bankruptcy: just your husband or both of you


the credit card: whose names are/were on the account? Just hubby or hubby and wife
