Leased Truck and voluntary repo. Now collections demands payment.


What is the name of your state (only U.S. law)? Idaho

My Significant Other (S.O.) had a leased vehicle with her ex husband and due to divorce was forced to return the truck. In the divorce agreement her mother made, it absolved her ex husband of all responsibility of payment for the truck. A month later due to inability to pay she voluntarily returned the truck. Now a Year later a collections company representing the finance company is claiming that she needs to pay the remainder of the loan. The truck has since been sold at the depreciated value. Is the company trying to pull something sneaky and get paid double for the truck. Thanks.

The finance company was not a party to the divorce. They can and are holding him responsible for the defecit.

so they can still hold her and her ex financially responsible even though it was a voluntary repo on a lease?
