Letter from national enterprise systems


What is the name of your state (only U.S. law)? California

I received a letter from these people regarding a Care Credit account opened in 2004. BACKGROUND: When this acct was originally opened there was supposed to be a 12.99% interest rate, but from the first billing cycle it was 26.99%. My continuous calls to care credit ended up with them telling me that my dental office incorrectly coded the billing so my dental office has to submit the correct code in order to get the correct interest rate. I informed my dental office of this and they said they did in the first place. Fast forward about 9 months, after numerous weekly calls to care credit and dental ofc, I had care credit get on the line with the dental PFC and they walked dental off through the process of changing the billing code.. Care credit then told me that this was now taken care of and would take 2 billing cycles to show up at which point all proper interest rate credits would be retroed back to the beginning. Also, that interest rate would actually be 9.99% because the 12.99% was no longer a valid promotion as 9 months had passed.. I replied that's fine as long ad I'm not paying 26.99% and I acknowledged the 3% benefit in my favor..

Fast forward to now: the billing NEVER changed percentage rates and after dealing with them for 3 1/2 years, I finally gave up.. They kept telling me that their system wasn't recongnizing the 9.99% because that wasn't offered at original billing and won't recognize 12.99% because THAT ONE wasn't in effect when the corrections were made and thus my 3 1/2 year problem... They said I was now stuck paying the 26.99%.. I told them that wasn't going to happen and bottom line was I just stopped paying. I couldn't handle the stress of it any longer...

I called national enterprise systems and they said that the total was $7341.12 and that their bottom line was $4400.00 which I have 5 days to come up with or this is scheduled to go to judgement.. I said I could make pymts on that but did not have access to $4400.00 in the next 5 days. They told me then I'll be going to court. They said the judgement would be for the entire amt of $7341.12 plus any and all atty costs and they would levy my bank acct, all property if I own, and wage garnishment of 25% or more depending on what state I'm in... I informed them that I literally did not have that much cash but that I had no intentions to not pay what I do owe, but I would have to make pymts.. They said not possible and they would see me in court and said they wished me luck. I said thank you for all your help and hung up..

What can/do I do now? I don't want to be sued and NSE said there's nothing they can do about the care credit issues, its not their problem now...

Your choices are either pay up or go to court.

Update


When calling back this agency to see if there was ANYTHING that could be done, I inadvertently got transferred to their Compliance Department (thank god) because this very nice, pleasant woman told me there was no need to take my son out of preschool in order to try to pay this off( which the man I spoke with earlier said he wouldn't accept pymts anyway) and she told me that man had NO AUTHORITY to say what he did to me or threaten me with a lawsuit and lied to me saying their agency were the attorneys for the collection agency.. Anyway, long story short (I know, too late ) I'm paying $50.00 minimum per month with no interest and I just continue to pay it until the balance is paid off, before hanging up I said have a wonderful evening and she said "now you can send your baby to school tomorrow" What a nice woman, surprisingly..

I was shocked to hear that the man representing himself as an attorney earlier, was nothing of the sort and everything he told me was a complete and total lie.. Also, no one had told me about a "compliance department" through which I could set up pymts..

Maybe this could help someone else someday...
