How are liens processed? I keep reading about how people go to sell their house and then discover that there is a lien against it. How can there be a legal action/debt without the person being notified?
I hear that in many cases some disputed/unpaid medical bill results in a lien being filed. Then when the person goes to sell the house, he has to pay off the lien.
How would that be right if he never was given a chance to present HIS side to the judge?
Also is interest or anything else allowed to be added to that judgment (lien)?
What if in a community property state in particular the person with the supposed debt either dies or had a dementia? How would the survivor be able to defend anything when the person who supposedly incurred the debt is dead or mentally incapacitated?What is the name of your state (only U.S. law)? |
