Question

Loan SOL


What is the name of your state? WA

On January 24th, 2007, I recieved a letter from a debt collection agency trying to collect on a debt from Devry Institute. The last payment made on this debt was in June of 1999. Since then, I have not heard from anybody concerning this debt until the letter. I sent a notice of dispute (A family member told me they paid this) and was sent in return, the verification of the debt. After looking up all the statue of limitation information it seems that this is beyond the SOL. However, the debt was originally incurred in CA and in Jan of 2000, I left CA and am currently in the military. My current hometown is still CA, but Im stationed in WA. Is the SOL "tolled" for this debt or has it expired?? Someone please help!!!

I'm confused. How can you have made the last payment on the debt the year before it was incurred?

I remember a similar topic coming up on this forum before. As my (sometimes foggy) memory recalls, when one is in the military (perhaps have to be deployed?) then the SOL is effectively frozen. This applies to creditors AND debtors...

I'm sure I will be corrected if I'm wrong

I would also check to be sure Educational Institutions are included in SOL's, they may not as I'm pretty sure student loans are not included in them as well. Not sure but defintily research it.

I think the debt was incurred prior to 1999 when last payment made. re 2000 - I think OP is saying that is when they left Ca.
