lost lawsuit without ever knowing about it...


What is the name of your state? California

I had a Discover card that I stopped paying in 2003 and it went to collections and Eskanos & Adler is the law firm that has been handling the whole thing.

the problem is... i was using a permanent address on my credit card bill rather than a home address. when i was paying the bill i paid it online so not having a bill wasn't a problem.

my permanent address is my sister's house and that is the address that all the collection letters and the legal paperwork was all sent. I don't even live in the same city.

anyhow... i apparently lost the suit one year ago and i've just now discovered this fact. is there a way to get the judgment reversed or overturned?

if not, what kind of offer do you think they will accept? after attorney's fees and late fees the debt is right around $10,000 (from a $5,000 credit card). i've got just over a third of that amount, but i'm hesitant to call them before seeing what my options are.

i also found out that they had emptied the bank account that was associated with that account on two separate occasions, but the account was a joint account between myself and my sister and is an account that i hadn't had anything to do with since 2003.

What does you sister say about that? I can't imagine her being anything other than irate.

I think you're too late to have it overturned. Who knows what they'll accept? Call and ask.
