Marriage and assuming debtsWhat is the name of your state? California I have a small amount of debt (approx $15,000) dating back many years. I have always been an honest person but I have been through alot of rough times and have never been able to keep my head above water. Now I am unmarried and dating a wonderful man (this guy has excellent credit). My question is, should we become married, does he become responsible for my past debts? And if I were to die, is he responsible for them as well? |

| He is not responsible for your debts, since they wouldn't have occurred during the marriage. However, if these debts are within the statute of limitations, watch out. How old are these debts? The statute of limitations is only 4 years in CA. After that time, if you are sued, you have an affirmative defense. |

| Yes try for statute of limitations, Otherwise be careful on that one. Lets say they get a joint account, and they go after her- part of the joint account? Anyway how long ago was the last contact with the debt and what kind of debts were they. |
