misty01What is the name of your state (only U.S. law)? florida I recieved a Writ of Garnishment. I don't work. I go to school. We live off of my husband's salary. Can our bank account be frozen, when the only money that goes in it is his paycheck? |

| If you received a writ of garnishment, it is apparant that you are a judgment debtor meaning that a judgment is lievied against you. Until that judgment is satisfied, the judgment creditor has several remedies avaialble to collect. They include (a) wage garnishment (apparantly not applicable in your case), (b) attachment of bank accounts, securities accounts, CD(s), (c) liens on real and personal property, (d) future proeeds from pending settlements etc. Now, the good news is that each state provides certain exemptions which you may claim. I would counsel you to speak with an attorney who can tell you what exemptions you are entitled to and how to assert them in your state court. Hope this helps. |
