Motion for alias contempt citation


What is the name of your state? Colorado Question: I recieved a motion for contempt citation from the jefferson county court system. It claims it issued a contempt citation with a return date of May 7 08. I never recieved this citation....Im being ordered to appear on the 18th of June 08...How do I proceed?

You show up for court on the 18th !!!
Apparently you have a judgment against you, you were sent papers for a 'debtors exam' to discover your assets. If those papers aren't answered in full and filed, they go for the contempt action and force you into court to answer the questions about your assets. If you don't show up on the 18th, the can and might issue a warrant for your arrest.

You could try calling the court clerk and find out if there's a record of the service and see where the original notices actually went. Won't get you off the hook, but at least you'll know.

You may also want to consider calling the lawyer for the plaintiff/creditor and having them send you another set of the post-judgment discovery. You are going to have to answer the questions - you might as well start working on them and be prepared to provide them to the creditor at the hearing.

The court is going to order you to do it by a very short timeframe at the hearing. You may also be liable for fees for the contempt hearing.
