Question

Moving to Florida


What is the name of your state?NY


I have a judgment filed against me, the creditor is trying to garnish 10% of my pay check after I was unable to complete a previous agreement. They put a Levy on my bank account and my account is currently frozen. The New York Marshall serve my company with the order of garnishment but my company rejected due to child support enforcement. According to NY laws, 25% is the maximum combine garnish by law and child support takes priority. 25% goes to child support so they have to wait 10 years to get anything from me. I had a conversation with the NYS Marshall and he is full aware of my situation, however he recommend to me to send to his office anything I can every week to show that I have intentions to pay this debt and I’m currently doing that. I’m moving to Florida next month and I will continue to send money to the NYS Marshal every week. Here are my two questions.

1. If I open a new checking account in FL can this creditor levy this new account?

2.If this is the case how long is going to take them to levy my new account?
