National Account Adjusters


What is the name of your state? Ohio

Greetings,

I recently received a telephone call from National Account Adjusters, informing me they had purchased a debt the believe owed by me to the University of Utah for medical services in June, 1990. I have no recollection of going to this hospital for anything other than an on the job broken collarbone which was covered by the companies policy. I never received a bill from them and never thought anything more about it. I moved from the state in July 1990 and have never returned.

Fast forward to now, this company claims they bought this debt from the hospital. The person on the telephone wanted my SS# to confirm my ID, but I only gave the last 4 digits. They claimed they had the right person. They will not tell me the date of service, or what medical services were performed. They were asking for over a grand. I said no, prove to me I even received services because other than the collarbone, I have no recollection of any service there . Show me the bill. They could not. I asked why I have never been contacted or sent a bill over these 16 years, they claimed some attempts were made to contact me in Utah in the early 90's at addresses I had never even lived at! The claim person then started talking about settlement for goodness sake. I told him I receive SS disability, so even IF the debt was real, my means to pay is very limited. He then abruptly told me he would mark the case as "inability to pay", and it would probably be dropped. Today I received a letter asking for some 3 hundred dollars, and still no proof that I even received medical care.

Do they have any leg to stand on legally without affirming the debt is real ?

What about the statue of limitations here? .... over 16 years.

Am I being fished for money from these people ?

I don't plan on talking with them anymore .

I know this is an old post, but I just had to respond. Two days ago I got the same kind of call from these same people. I also told them to prove it because I really don't think it is a legitimate debt cause I had my last child in 95 and KNOW I didn't have any medical costs for at least two years after he was born, and definitely not $800 worth, and they told me that only the hospital had that information. My supposed debt was in 1996, 11 years ago.

So I called the hospital, they also could not tell me what it was for, only a date of service. So I called the collection agency back and told them the hospital couldn't find anything either. The girl put me on hold to get her supervisor so they could "get to the bottom of it" for me. Oh my, what a jerk!!! This guy yelled at me, called me names, told me they were recording my conversation, and actually baby talked to me saying, Oh you're going to call your attorney", like literally baby talked to me. I asked him how old he was so he asked me how old I was and then said, "Oh you don't have to answer that, I have your file I know exactly how old you are". Now if that is not intimidation I don't know what is, almost threatening to tell you the truth. He also told me that they do not need to send me a bill, that it is a privelidge for me to get a bill and that I am just suppose to take care of my debts. Well if I don't get a bill for services I incur, how am I suppose to know what to pay my debtors? Especially medical bills, it's not like they tell you exactly how much it is going to cost, please! Am I just suppose to send them a blank check? I have never in my life had anyone talk to me on the phone this way, and this guy was supposably the supervisor. He was literally yelling at me. He asked me if I was going to pay the bill and I said no, you should have heard how mad he got then. Well, I did call my lawyer as soon as I hung up, thank God for Pre-paid Legal! My lawyer said that on medical bills in this state (Utah) they can not attempt to collect on a debt older than 4 years, and if you sign a promise to pay, not longer than 6 years. He also said that he cannot by law try to collect a debt by force and that includes yelling. So if they were recording the call, which I hope they did, but you know they'll say they can't find that tape or some story, I can get him for forcibly trying to collect a debt and trying to collect a debt after it is no longer legally owed.

So he told me to call them back and get them to send me a demand for payment by mail, so I did. As soon as I get that I am sending it back to my lawyer and he said I can sue them for $2,000! So that is exactly what I am going to do. This guy was a real jerk!! He'll be sorry he called me, or maybe he won't but I think this particular company is doing this same thing to a lot of people, trying to collect debts that are no longer owed, and unfortunately there's probably a lot of people who will pay it or make arrangements to pay it. What my attorney said about the statutes is correct, so I'm really hoping a lot of people see this post and fight it.

Stop collection agencies like this from operating. Collecting a legitimate debt is one thing, collecting one that cannot be collected upon is another and doing it forcibly in the way they are doing it is absolutely inexcusable. I understand the need for debt collections, I've had to collect a debt once or twice myself, but never like this! Stop National Account Adjusters Debt Collections!!!!

National Account Adjusters - Outlaws


The previous two stories are par for course for the National Account Adjusters - abusing people at all costs. I am sure there are many people out there who have similar stories. Well its time to do something.

First, write a letter explaining your case.
Send it to the following people:

1. The Attorney General of Utah takes over cases from the state That the National Account Adjusters are not handling well.

The Attorney General of the State of Utah
Utah State Capitol Complex
East Office Building, Suite 320
Salt Lake City, Utah 84114

2. If it is involving Unversity of Utah University Health Care:

University Health Care
5th Floor Moran
175 N. Medical Drive East
Salt Lake City, Utah 84132

Also be sure to encourage them to NOT TURN THEIR ACCOUNTS OVER TO NATIONAL ACCOUNT ADJUSTERS!

3. you can also petition the president of University of Utah:

Michael Young
Office of the President
John R. Park Buidling
201 President's Circle Room 203
Salt Lake City, UT 84112.

4. The state of Colorado has some safeguards on Attorney Regulation:

You must call to file a complaint
go to the Colorado Supreme Court website or try (303) 866-6400

Denver, CO 80203

Your lawyer is wrong. That advice can cost you quite a bit. If you wish to pursue a case against them, I strongly advise you contact a consumer rights attorney through NACA.

Umm, no. Your Pre-Paid Legal "Attorney" is wrong. You should research SOL on this site.

If you want advice, we happy to help. You shouldn't be mistreated, but the information you got is not correct.

Consumers may sue for violations of the FDCPA. However, the compensation is limited to $1,000 per action - not per violation. Which means the max the lawyer could get is $1k. And pre-paid legal attorneys... well, as an agency owner I wouldn't worry about them at all. You should contact NACA. Google it.

One more Thing


I wrote a letter with 5+ ways that National Account Adjusters broke the law. Contact me if you want it.
