I went to a lawyer for a custody issue about 2 years ago. He told me is was completly covered by our insurance. We informed we could not do anything that was not covered by the insurance. He told us the decree modification was covered all we had to pay were the filing fees. So we paid the 150.00. After everything is all done and over with he calls and tells us that the way he ran it through the insurance was not covered so he would have to run it a different way. We said that was fine. A few months later we got a letter/bill saying he could not get the insurance to cover it and now we owe him for all his fees. First off, is this legal on his part since we stated that we could not pay unless it was covered?

Now, my husband got served yesturday saying he is sueing him for the amount owed. What can happen in court about this? Can the garnish wages in Texas for this? The amount owed is only 421.00.

Also in the papers it says the following

"You have been sued. You may emply an attorney. If you or your attorney do not file a written answer with the clerk who issued this citation by 10:00 AM on the Monday next following the expiration of ten days after you were served this citation and petition , a defalwas filt judgement may be taken against you. Said petition was filed on the 4th day of May, 2007. "

How do we file a answer? We do not have money to hire a attorney so what do I do from now?

You most likely signed a paper that you would be responsible for any fees not covered by insurance.

What kind of insurance covers a LAWYER'S fees???
