Need Advice on CCs Debt and get rid of CAs callWhat is the name of your state? Tennessee Hi, I am now in CCs Debt of about $12,000.00 with 2 cards (MBNA - 1 CC and 1 Debt Consolidation loan plus 1 Amex CC). Now I was a foreign student in Tennessee and made those debt. I heard that collection agency called at my brother's house who lives in Canada as I lived for couple of months in house and used cards from there. Now I am back here in USA. I stopped payment since september '04. Someone is calling my brother's house and even my old address (TN) leaving message with a case no. After this, I thought of start paying but I don't have any job yet. I am just living hand-to-mouth. Now , please advice what should I do? Can I contact with the credit card companies or shoud I call to the CA(may be)? What would be the consequences if someone don't pay and live in Canada? I thank you in advance and will be greatful to you for your valuable advice. |

| I don't know the answer about living in Canada. However, if you are back in the US, you can surely be sued. Just because you are not a citizen would not keep you from being sued. If creditors are calling your brother's home and old addresses, that just means they are trying to track you down. There is nothing illegal per se about their attempting to find you so long as they don't violate FDCPA as to 3rd party disclosure. From your comment, it does not sound like they are doing anything wrong at this point. If you give the creditors your new address and phone number, they will contact you to collect the debt and may bring legal action. If you don't give them your new address and phone number, they will keep searching for you and will probably find you eventually. You are the only person who can decide if you should or should not call the creditors with the new contact information. Weight the pros and cons and decide. However, this problem is not going to get better until you put this behind you. |
