need a bit of advice


What is the name of your state?nevada

ok so here's my deal. i just got served with papers over a credit card debt. initially i was upset because my ex-wife had said she would take care of this as it was all her. now i don't need any i told you so's about you should have gotten that in writing and such. i already know this part. i tend to be a trusting soul, these are not the issues.
so i had already planned on moving in about a week and a half. already had my notice turned in and all that. so since there is not legal way to make her pay for this stuff i am stuck with it. i'm ok with that, because i have to be. the debt itself is about 3 and 1/2 years old if that matters in this forum. the problem is i haven't called the attorney yet, because i'm not sure what to tell him/her. i need the time to drive to where i'm moving and get settled in and find a new job. i'm perfectly willing to work with them on paying this down but i'm worried that i could lose my car or something like that. maybe they slap a boot on it and then i'm stuck in nevada. really want to work with them but not sure what my first move should be. i've tried to get in touch with a freind of mine who is a laywer, but, he's been really busy. so i'm just trying to figure out where to start on this mess. thanks for any help.

You have already been served. If you don't respond, they will be awarded a judgment.

You can buy yourself some more time by filing a general denial.

Since you are moving to another state, they will have to export the judgment to that state in order to garnish wages, attach assets, etc.

You say you want to resolve this. If so, just go ahead and call the lawyer for the credit card company -- it does not take a lot of time. Maybe you trade calls for a while if you are tying to negotiate -- but so what?

Don't worry about a boot on your car anytime soon. It takes a while to get the judgment. Even then, attaching a vehicle depends on what state you live in at the time.

thanks man,
i really appreciate it. it sucks that she pulled this on me but, i guess thats why she's my ex. just didn't want to do the wrong thing by accident. thought i'd talk to an outside party first. i just couldn't imagine that their lawyer had my best interests at heart. as long as he can work with me on this, i'll be able to fix this mess. thanks again.
